1.1 These terms and conditions of use applies to all services (both direct or indirect) offered online by Topservices.ng, a web solution powered by Emkan Global Resources (“Topservices.ng”, “we”, “us”, “our”, “ours”) and it is binding on everyone who makes use of any, some, or all of these services (whose the terms “you,” “your”, “yours”, “their”, “them”, “themselves”, can also refer) including but not limited to:

(a) Customer (any individual or legal entity who has created an account on topservices.ng website in order to submit a request or request for services and who may also be referred to as the client);

(b) Provider (any individual or legal entity who has created an account on topservices.ng website and may publish different types of information or data such as texts, articles, photographs, videos etc in his account profile in order to offer services to customers and who may also be referred to as the services provider or the professional).

1.2 Topservices.ng has the legal right to at any time modify its products and services, pricing, offerings, website content and functionalities without being liable to any type of compensation claim from the user, customer or provider. Consequently these terms and conditions of use may be revised and modified at any time and Topservices.ng cannot be held liable for such revisions and modifications. Therefore, it is strongly advised that you review them each and every time you use any of our services or browse and do anything on our website.

1.3 By using our website or utilizing any of our services, you agree that you will not make any unlawful use of the website and any of its contents. Topservices.ng reserves the right to terminate your use of its services without being liable for any form of compensation claim or damages. We also reserve the right to block your account or suspend your access to our platform where need be without being liable. At any point in time where you are not satisfied with our services or where you are no longer in agreement with our terms and conditions of use and our privacy policy, you agree that you will immediately stop the use of our services and quietly walk away without making any demands for compensations or damages.

1.4 Topservices.ng serves to link service providers to customers through its website. Our website provides a medium through which the service providers and the customers can interact. Service providers can create account, upload or post their information and/or data on their account profiles and customers can see these information and/or data and may then book or request for their services. A customer can also create his account; post his request in order to get responses or quotes from the service providers. The information provided by the service providers and the costumers via Topservices.ng website belongs to them and they are solely responsible. Topservices.ng is not responsible or liable for any of these information or for the validity, correctness, completeness, authenticity, originality etc of the contents displayed on a service provider’s profile or a customer’s account and posts. Topservices.ng is not an employer of any of the service providers registered and listed on its website and the service providers are not its subordinates. Topservices.ng does not in any way interfere in the interactions and negotiations between the service providers and the customers. Topservices.ng only serves to show a list of available service providers and the customer’s choice of a service provider is solely his responsibility. Topservices.ng is not a guarantor or a shortie for any service provider or any customer. The decisions and actions of the customer and the decisions and actions of the service provider are solely their responsibilities and Topservices.ng declines every liability from the outcome of their postings, interactions, decisions, actions, operations, and transactions. Topservices.ng is not responsible for settling disputes between service providers and customers.

2. PROVIDER PACKAGES

A service provider on Topservices.ng is free to choose one of these provider packages: Free4eva, Large, and Mega. The default sign up package is the Free4eva package. You can upgrade your account any time after sign up to any of the premium packages in order to enjoy more functionalities and privileges.

The Free4eva package as the name implies is offered free but the provider may be required to provide a valid payment method at the point of sign up for verification purposes. The Large and Mega packages are premium packages which attracts the payment of stipulated amounts which are valid for 90 days. All providers are required to provide a valid means of identification as will be determined and reviewed from time to time by the admin of Topservices.ng. The providers on the premium packages will be given preferential support services. The providers on the premium packages can decide to renew the package on expiry by the payment of the stipulated amount. You can choose to upgrade or downgrade your premium subscription or package any time to suit your needs and budget. You can also choose to remain on the same package if it meets your needs. Upon the expiry of your package, your account will be downgraded to a no package status and your public profile will no longer display. You can then re-choose any of the plans or we may choose the Free4eva plan for you. Monies already paid to us for account packages cannot be refunded.

3. PAYMENTS

All payments on Topservices.ng are made using the Nigerian Naira via two payment methods:

(a) Debit or credit card payment: Here all payment gateway charges are born by the payer and not Topservices.ng.

(b) Direct Bank Transfer (or wire transfer): Here funds are transferred by electronic means to our bank account detailed below:

Topservices.ng declines responsibility or liability on any funds paid into any other bank account except the one detailed above. Topservices.ng also declines responsibility and liability for any funds not paid on our platform. Topservices.ng also strongly decline responsibility and liability for any funds paid to any service provider or any customer.

4. FEATURED PROVIDERS

A provider can request to be featured on the topservices.ng website. After the payment of an amount to be stipulated by our admin, the featured provider status will be approved for a specific period of time. Featured providers are entitled to preferential supports, randomized top positions on our category and search pages. You can cancel your featured provider status from your profile before it auto renews. Here monies already paid to us are non-refundable.

5. JOB POSTINGS

5.1 Job posting is free (we do not charge you for posting your job) but the amount for the Job must be paid for in full. The paid amount remains with Topservices.ng until the job is completed. Upon complete execution of the job, the customer will conclude the process from his account before the fund is released to the service provider. A 10% website commission will be deducted from the amount to be released to the service provider. Topservices.ng is not responsible for other subsequent or offline engagements of the customer and the service provider. Topsrvices.ng is not also responsible for any money paid directly to a service provider and cannot be held liable for such payments.

5.2 To post a job, you must sign up or sign in as a customer. Your job posting must be authorized before it is displayed on the website. Topservices.ng reserves the right to edit the content of your posting before or after its authorization. Service providers have the right to apply and bid for posted jobs. The selection of a particular provider to handle a job is solely the responsibility of the customer. The final outcome of job posting, provider selection, and job execution are the sole responsibilities of the customer and the service provider and Topservices.ng will not be held responsible for any of these. We decline to accept a guarantor or shortie status for either the customer or the provider.

6. POSTINGS AND ARTICLES

A service provider may post articles from his account. Such postings or articles will display on our website and we reserve the right to edit, delete, optimize for search engine and display our sponsored advertisements on the post page. You hereby agree that the content of your articles or posts are original and devoid of piracy or plagiarism. The content of the articles or posts remains the sole responsibility of the poster (customer or provider) and we will not be held liable for any plagiarism or pirated content. You (the poster, customer, provider) hereby accept to be totally and fully responsible for the originality of your postings or articles and fully and totally liable for pirated or plagiarized contents. For now, we only accept posts or articles written in English language on our website.

7. ONLINE BOOKINGS

A customer can request for quotes from a provider and the provider is free to respond to such requests. These requests and responses are the responsibilities of the customer and the provider and Topservices.ng will not interfere in any of these. Topservices.ng will not be held responsible for the outcome of the interactions between the customer and the provider. Complete online booking process will require that the customer pays the amount agreed between the customer and the service provider to Topservices.ng. The paid amount will remain with Topservices.ng until the job is executed and completed by the service provider. The customer will have to mark the work as completed before the funds are released to the service provider. The released amount will be less a 10% website commission which will be charged by Topservices.ng. The commission will be charged from the amount due to the service provider.

Topservices.ng is not responsible for any money paid directly to a service provider and cannot be held liable for it.

8. RATINGS AND REVIEWS

Ratings and reviews of service providers are done by the customers and members of the public. As a service provider, you authorize the reviews and ratings of your performance. Topservices.ng has no control over the ratings and we cannot guarantee the accuracy and truthiness of the reviews as these are solely the individual opinions of the rating public.

9. SECURITY

9.1 The customers and the service providers have the responsibility of choosing strong passwords for their accounts and to safeguard their passwords against compromise.

9.2 Topservices.ng is committed to safeguard its web platform within the limits of its powers against the risks of hacking, malicious intrusions and deployment of any virus on its platform or emails. We also use industry standard SSL encryption to protect data transmissions to aid your privacy and security. Since no data transmission over the internet can be considered to be one hundred percent secure and despite our best efforts to safeguard our website against the above risks, we do not guarantee that the above will not occur and in event where any of it occurs, we will not be held responsible and we decline every liability arising from such occurrences.

9.3 The security of the lives and properties of the customer and the service provider is totally their responsibilities. Topservices.ng will not be held liable for any security bridges. Therefore, the customer and the service provider both have the responsibilities of protecting themselves and their properties and carrying out the necessary due diligence in the course of getting their jobs done and/or doing their businesses.

Back links to other websites may be found on Topservices.ng website. These websites are operated by other parties and are provided for reference purposes only. We do not in any way endorse the contents of these websites as we do not participate in their managements and operations. Your use of these websites is solely your responsibility and we decline every liability arising from such uses.
